These Terms & Conditions ("Terms") govern your use of Digibility’s website, platform, and related services.
By accessing or using Digibility, you agree to these Terms.
1. About Digibility
Digibility is an AI-assisted marketing platform that helps businesses with onboarding, analysis, content planning, content creation workflows, approvals, scheduling, publishing, reporting, and related marketing operations.
2. Eligibility
You may use Digibility only if you have the authority to enter into a binding agreement on behalf of yourself or the business you represent.
3. Accounts
You are responsible for:
- keeping your account credentials secure;
- ensuring that account information is accurate and up to date;
- all activity that occurs under your account.
You must notify Digibility promptly of any unauthorized access or security issue.
4. Subscriptions, Billing, and Auto-Renewal
Digibility may offer paid plans on a monthly or annual basis. Paid subscriptions renew automatically unless canceled before the next billing cycle.
By subscribing, you authorize Digibility or its payment processor to charge the applicable fees using your selected payment method.
Digibility may change pricing, features, quotas, or plan structure from time to time. Where required, Digibility will provide notice before those changes take effect.
5. Trial Access
Digibility may offer a free trial before a paid subscription begins. Trial terms, duration, and conversion behavior are described on the website or checkout flow.
Unless otherwise stated, the trial is intended to help you evaluate the service before moving to a paid plan.
6. Cancellations
You may cancel your subscription at any time to stop future renewals. Unless otherwise stated in a separate refund policy, cancellation does not reverse charges already billed for the current term.
If you cancel, access continues until the end of the paid billing period unless your account is suspended earlier for a violation of these Terms or applicable law.
7. Platform Workflows and Approvals
Digibility may use workflow deadlines, reminders, and approval windows to keep delivery on track. Where clearly stated in-product or in service documentation, certain workflow steps may proceed automatically if required feedback is not provided within the stated time.
8. Acceptable Use
You agree not to misuse Digibility, interfere with the platform, violate applicable law, infringe intellectual property rights, upload unlawful or harmful material, attempt unauthorized access, or use the service in a way that could damage Digibility, its users, or third parties.

9. Third-Party Platforms
Digibility may connect with third-party platforms and services. Your use of those third-party services remains subject to their own terms and policies.
Digibility is not responsible for third-party downtime, policy changes, API restrictions, account actions, or feature limitations imposed by those platforms.
10. AI Features and No Guaranteed Results
Digibility uses AI-assisted workflows and automation. Outputs may vary and may require human review.
Digibility does not guarantee specific business outcomes, including reach, engagement, leads, sales, rankings, or revenue.
11. Intellectual Property
Digibility and its website, software, branding, interface design, workflows, and related materials are owned by Digibility or its licensors.
Subject to payment of applicable fees and your compliance with these Terms, Digibility grants you a limited, non-exclusive, non-transferable right to use the service during the subscription term.
12. Ownership of Customer Content
You retain ownership of the materials, information, and source assets you provide.
Subject to your payment of applicable fees, you own the final customer-facing content generated or delivered for your use, except for Digibility’s pre-existing software, models, templates, systems, and proprietary tools.
13. Testimonials and Case Studies
You agree that Digibility may refer to your name, brand, logo, or campaign outcomes for reasonable customer-reference, case-study, or testimonial purposes, unless you ask Digibility in writing not to do so.
14. Suspension and Termination
Digibility may suspend or terminate access if:
- fees remain unpaid;
- a payment is reversed or charged back;
- you violate these Terms or the Acceptable Use Policy;
- your use creates legal, security, or operational risk.
Digibility may restore access after a payment issue is resolved, where restoration is commercially feasible.
15. Disclaimers
Digibility is provided on an "as is" and "as available" basis to the maximum extent permitted by law.
Digibility disclaims all implied warranties to the extent permitted by law, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
16. Limitation of Liability
To the maximum extent permitted by law, Digibility will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenue, data, goodwill, or business opportunities.
To the maximum extent permitted by law, Digibility’s aggregate liability arising out of or relating to the service will not exceed the total subscription fees paid by you to Digibility in the three (3) months preceding the event giving rise to the claim.
17. Governing Law and Jurisdiction
These Terms are governed by the laws of India.
Any disputes arising out of or relating to these Terms will be subject to the courts located in Pune, Maharashtra, India, unless applicable law requires otherwise.
18. Changes to These Terms
We may update these Terms from time to time. Continued use of Digibility after the updated Terms become effective means you accept the updated Terms.
