Introduction

These Terms & Conditions govern your access to and use of Digibility's website, platform, visibility workflows, Founder Visibility Score, Founder Visibility Pilot, content planning tools, AI-assisted workflows, approval workflows, publishing workflows, reports, analytics views, action signal tracking, support services, assisted services, managed services, and related offerings.

These Terms apply to all visitors, users, customers, account owners, team members, employees, contractors, agencies, brand managers, administrators, and any person or entity accessing or using Digibility.

These Terms should be read together with Digibility's Privacy Policy, Refund & Cancellation Policy, Acceptable Use Policy, Data Processing Addendum, Subprocessors page, and any applicable order form, invoice, proposal, subscription agreement, or service agreement.

Acceptance of Terms

By accessing, browsing, purchasing, subscribing to, registering for, or using Digibility, you confirm that you have read, understood, and agree to be bound by these Terms.

If you use Digibility on behalf of a business, company, organization, client, or other legal entity, you confirm that you have authority to bind that entity to these Terms.

If you do not agree to these Terms, you must not access, purchase, subscribe to, or use Digibility.

About Digibility

Digibility is a Visibility Management Platform for founder-led and expert-led businesses. It helps users capture founder inputs, plan visibility workflows, generate content drafts, manage approvals, publish through supported workflows, track visibility signals, review reports, and improve content consistency.

Digibility may provide software, dashboards, AI-assisted features, templates, workflows, reports, recommendations, visibility scores, content drafts, campaign plans, social media workflow support, assisted services, managed calibration, and related services.

Digibility is not a lead generation guarantee platform, sales guarantee platform, legal advisor, financial advisor, medical advisor, tax advisor, compliance advisor, or professional services substitute.

Eligibility and Account Responsibility

To use Digibility, you must be legally capable of entering into a binding agreement and must provide accurate, complete, and current account information.

Users are responsible for:

  • Maintaining account credentials
  • Controlling access by team members
  • Ensuring authorized use
  • Verifying business details
  • Approving content before publication
  • Managing connected platforms
  • Maintaining billing information
  • Backing up important assets and records
  • Complying with these Terms and all referenced policies

Digibility is not responsible for losses, errors, unauthorized approvals, publishing decisions, account misuse, or data issues caused by user-side account misuse, credential sharing, weak passwords, unauthorized team access, or failure to secure account access.

Features may vary by plan, billing status, user configuration, region, connected platform, permissions, product changes, and third-party availability.

AI-Assisted Features

Digibility may use AI-assisted systems, models, tools, and third-party service providers to generate or assist with content ideas, captions, creative directions, content calendars, campaign plans, reports, summaries, visibility recommendations, and other outputs.

AI-generated or AI-assisted outputs may contain errors, hallucinations, incorrect facts, outdated information, unsupported claims, unsuitable wording, bias, or content that may not comply with law, platform rules, industry requirements, or brand standards.

Users must verify: factual accuracy and business details, offers and pricing, campaign dates and terms, product/service availability, legal/medical/financial claims, intellectual property rights, platform compliance, and tone and brand suitability.

Users are responsible for reviewing, editing, verifying, approving, and authorizing AI-generated or AI-assisted output before use, publication, distribution, sharing, or reliance.

User Content and Approval Responsibility

All content generated, drafted, uploaded, edited, approved, scheduled, published, copied, downloaded, distributed, or used through Digibility remains the responsibility of the user. Approving content means the user confirms that they have reviewed it and accept responsibility for publishing, using, distributing, or relying on it.

Sensitive content requiring extra review includes offers, pricing, regulated claims (legal, medical, financial), founder statements, and customer-facing promises.

Digibility does not independently verify the accuracy, legality, truthfulness, permissions, claims, offers, prices, availability, compliance, or suitability of every piece of content.

Acceptable Use

Users must use Digibility only for lawful, authorized, responsible, and permitted business purposes. Users must not create unlawful content, violate third-party rights, impersonate others, or abuse system resources.

Third-Party Platforms and Integrations

Digibility may connect with third-party platforms such as Instagram, LinkedIn, Google Business Profile, etc. These platforms are not controlled by Digibility. Their own terms, privacy policies, APIs, and rules apply.

Digibility is not responsible for third-party outages, API changes, account restrictions, or platform policy changes. No refund or compensation arises from such third-party issues.

Visibility Scores, Reports, Analytics, and Action Signals

Visibility scores are diagnostic estimates and do not guarantee business outcomes. Action Signals (tracked clicks) such as website clicks or booking clicks are indicators of intent and not confirmed leads or sales unless separately verified.

Digibility does not guarantee completeness or accuracy of third-party metrics, as they depend on platform permissions and data availability.

Plans, Billing, and No Refund Policy

By purchasing, you authorize Digibility to charge applicable fees. All payments are final and non-refundable.

Strict No Refund Policy

Digibility does not provide refunds, partial refunds, or credits for unused time, credits, satisfaction issues, change of mind, business closure, or expected results not being achieved. This applies to all subscriptions, pilots, setup fees, and managed services.

Cancellation and End of Billing Cycle

Users may cancel anytime. Cancellation stops future renewals but doesn't result in a refund for the current cycle. Access continues until the end of the current cycle unless terminated for policy violations.

Credits and add-ons are non-refundable. Unused credits do not automatically convert to cash. Digibility is not a permanent storage platform; uploaded assets may be subject to limits and retention periods.

Pilot and managed workflows require timely user feedback and approval. Assisted services involve system resources and planning; fees are non-refundable once work has started or access has been provided.

Intellectual Property

Digibility owns all platform technology, workflows, prompts, templates, and proprietary materials. Using Digibility does not transfer ownership. Users grant Digibility a license to host and process their content to provide services.

Privacy and Data Processing

Privacy practices are described in our policies. Users must ensure they have all rights and consents to provide data to Digibility.

Disclaimers

Digibility is provided "as is". We disclaim all guarantees regarding leads, sales, rankings, organic visibility, search rankings, followers, or algorithm results. Actual outcomes depend on external factors like market demand, pricing, and execution.

Limitation of Liability

To the maximum extent permitted by law, Digibility shall not be liable for indirect, incidental, or consequential damages. Total aggregate liability is limited to one month's fees or INR 5,000, whichever is lower.

Indemnity

Users agree to indemnify Digibility against claims arising from their content, platform misuse, privacy violations, or breach of these Terms.

Suspension and Termination

Digibility may suspend or terminate access for violations of terms, non-payment, or security risks. No refunds are provided for terminations caused by policy violations.

Governing Law and Jurisdiction

These Terms follow the laws of India. Disputes are subject to the exclusive jurisdiction of courts in Pune, Maharashtra. Before formal proceedings, contact us at info@digibility.ai to resolve issues.

Changes to These Terms

We may update these terms periodically. Continued use reflects acceptance of the revised terms.
